Chroma8 Terms & Conditions

By downloading or using the app, these terms will automatically apply to you. You should make sure therefore that you read them carefully before using the app. You are not allowed to copy or modify the app, any part of the app, or our trademarks in any way. You are not allowed to attempt to extract the source code of the app, and you also should not try to translate the app into other languages or make derivative versions. The app itself, and all trademarks, copyright, database rights, and other intellectual property rights related to it, still belong to ColonDev (Pvt) Ltd ("ColonDev").

ColonDev is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you are paying for.

The Chroma8 app stores and processes data that you have provided to us in order to provide our Service. It is your responsibility to keep your phone and access to the app secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware, viruses, and malicious programs, compromise your phone's security features, and it could mean that the Chroma8 app will not work properly or at all.

You keep all rights to the pixel art, animations, and other content you create in Chroma8. ColonDev claims no ownership of it, and you are free to use, publish, and sell what you make, including in commercial games and projects, subject to the rights of anyone else whose work you include. If you turn on cloud sync, you grant ColonDev only the permission needed to store, process, and transmit your artwork for the sole purpose of running that sync for you.

You are responsible for the content you create. You must have the rights to any image you import as a layer, and you must not use the app to create or distribute content that is unlawful, that infringes someone else's copyright or trademark, or that you are not permitted to make.

You do not need an account to draw, animate, or export in Chroma8. An account is optional and is used for cloud sync. If you create one, you are responsible for the accuracy of the information you register with, for keeping your sign-in credentials confidential, and for everything that happens under your account. You must be old enough to enter into a binding contract in your country. Please tell us immediately if you believe your account has been used without your permission.

Chroma8 is free to download. On the free tier the app shows banner ads, and the number of exports you can make each day is limited. You may choose to watch a rewarded video ad to earn a limited number of extra exports for that day. Watching an ad is always optional and is never required to keep drawing or to keep the work you have already made. We may change the free daily export allowance, the number of bonus exports, and the way ads are shown, as the app develops.

Chroma8 Pro is an auto-renewing subscription that removes ads, gives you unlimited exports, and enables cloud sync for your Arts and Projects. Cloud sync additionally requires you to be signed in to an account. Chroma8 Pro is offered on a monthly and an annual plan, and may include a free trial period. The current price, plan length, and trial length are always shown to you in the app before you confirm the purchase, and prices may differ by region and may change over time.

If your subscription ends, ads return and the free tier export limit applies again. Your artwork is not deleted, but cloud sync stops, so you should make sure anything you care about is on your device or exported.

Chroma8 keeps your artwork on your device unless you enable cloud sync. That means deleting the app, losing the device, or resetting it will remove artwork that has not been exported or synced. ColonDev is not able to recover artwork that only existed on a device we never received it from. You are responsible for keeping your own copies of work that matters to you, by exporting it or by keeping device backups.

You agree to use Chroma8 only for lawful purposes. You must not use the app to create or store unlawful content, to attempt to access another user's data, to interfere with or overload the Service, to generate fake ad impressions or otherwise manipulate the rewarded ad system, or to circumvent any subscription check, export limit, or other access control in the app or in the services it depends on. We may suspend or terminate accounts that are used this way.

The app does use third-party services that declare their own Terms and Conditions.

You should be aware that there are certain things that ColonDev will not take responsibility for. Drawing and exporting in Chroma8 work offline, but some parts of the app require an active internet connection, including signing in, cloud sync, loading subscription products, and loading ads. The connection can be Wi-Fi or provided by your mobile network provider, but ColonDev cannot take responsibility for the app not working at full functionality if you do not have access to Wi-Fi and you do not have any of your data allowance left.

If you are using the app outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third-party charges. In using the app, you are accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory without turning off data roaming.

Along the same lines, ColonDev cannot always take responsibility for the way you use the app. You need to make sure that your device stays charged. If it runs out of battery and you cannot turn it on to use the Service, ColonDev cannot accept responsibility.

With respect to ColonDev's responsibility for your use of the app, when you are using the app, it is important to bear in mind that although we endeavor to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. ColonDev accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the app.

At some point, we may wish to update the app. The app is currently available on iOS. The requirements for the system may change, and you will need to download the updates if you want to keep using the app. ColonDev does not promise that it will always update the app so that it is relevant to you and works with the OS version that you have installed on your device. However, you promise to always accept updates to the application when offered to you. We may also wish to stop providing the app and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, the rights and licenses granted to you in these terms will end and you must stop using the app and, if needed, delete it from your device.

The app is provided on an "as is" and "as available" basis. We do not warrant that the Service will be uninterrupted, error free, or free from data loss, and parts of it depend on third-party services that are outside our control. To the fullest extent permitted by law, ColonDev excludes all implied warranties and is not liable for any indirect or consequential loss, or for any loss of profit, revenue, business, goodwill, or data, arising out of your use of the app. Nothing in these terms limits any liability that cannot be limited by law.

These terms are governed by the laws of Sri Lanka, and the courts of Sri Lanka have jurisdiction over any dispute arising from them, without affecting any mandatory consumer rights you have in your own country of residence.

We may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page.
